Terms of Service
These Terms of Service (“Terms”) are a contract between you and Warmvine (“Warmvine,” “we,” “us”). By joining our waitlist, creating an account, or using the app, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use Warmvine.
1. Eligibility
You must be at least 13 years old to use Warmvine. If you are under 18, you may use Warmvine only with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf. By using Warmvine you represent that you meet these requirements and that the information you provide is accurate.
2. What Warmvine is (and isn’t)
Warmvine is a personal self-coaching tool that helps you practice, analyze, and reflect on conversations using AI. It is intended for personal, non-clinical self-improvement.
Warmvine is not therapy, counseling, or medical, legal, psychological, or professional advice, and is not a substitute for them. If you are in crisis or need professional help, contact a qualified professional or your local emergency services.
3. Your account
You access Warmvine by signing in with Google. You are responsible for activity under your account and for keeping your Google credentials secure. Tell us promptly at support@warmvine.com if you suspect unauthorized use.
4. AI-generated content
- Warmvine’s practice partner, coaching, and analysis features are powered by generative AI (including Google’s Gemini). Responses are generated automatically.
- AI output may be inaccurate, incomplete, outdated, or inappropriate. We do not guarantee its accuracy or suitability, and you should not rely on it for important personal, health, financial, legal, or safety decisions. Use your own judgment.
- You must not use Warmvine’s AI features to generate unlawful, harmful, harassing, deceptive, or abusive content, or in any way that violates Google’s Generative AI Prohibited Use Policy.
5. Acceptable use
You agree not to:
- Use Warmvine for any unlawful purpose or to harm, deceive, harass, impersonate, or manipulate others.
- Upload content you don’t have the right to share, or that infringes others’ privacy or intellectual-property rights.
- Reverse-engineer, scrape, resell, or redistribute the app, its content, or its AI outputs, except as the law expressly allows.
- Interfere with, overload, or attempt to gain unauthorized access to the service or its infrastructure.
6. Your content
You keep ownership of the content you submit (your practice messages, chats, screenshots, and notes). You grant Warmvine a limited, worldwide, royalty-free license to host, process, and display that content solely to operate and provide the service to you — including sending it to our AI provider to generate responses, as described in the Privacy Policy. We do not use your content to train shared or third-party foundation models, and we do not sell it.
7. Subscriptions & payments
- Warmvine may offer premium features through paid subscriptions or in-app purchases. These are sold and billed through the Apple App Store or Google Play, subject to their terms.
- Subscriptions auto-renew until cancelled. You can manage or cancel a subscription in your App Store or Google Play account settings; cancellation takes effect at the end of the current billing period.
- Except where required by the applicable app store or by law, payments are non-refundable. Refund requests are handled under the policies of the store you purchased through.
- We may change pricing or the features included in a plan. Where required, we’ll give you advance notice, and price changes won’t apply to a billing period you’ve already paid for.
8. Intellectual property
Warmvine, its name, logo, software, design, and content (excluding your own content) are owned by us or our licensors and are protected by intellectual property laws. We grant you a personal, non-transferable, non-exclusive, revocable license to use the app for its intended purpose. All rights not expressly granted are reserved.
9. Third-party services
Warmvine relies on third-party services — including Google (Sign-In and the Gemini AI API), the Apple App Store and Google Play, and our payments partner. Your use of those services is also governed by their terms and privacy policies, and we are not responsible for them.
10. Disclaimers
To the fullest extent permitted by law, Warmvine is provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that AI outputs will be accurate or reliable.
11. Limitation of liability
To the fullest extent permitted by law, Warmvine and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or profits, arising from your use of (or inability to use) the service. Where liability cannot be excluded, our total liability is limited to the greater of the amount you paid us in the twelve months before the claim, or INR 1,000.
12. Termination
You can stop using Warmvine and delete your account at any time. We may suspend or terminate your access if you breach these Terms or to protect the service or other users. Sections that by their nature should survive termination (such as content licenses already granted, disclaimers, limitation of liability, and governing law) will survive.
13. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law rules. Subject to any mandatory rights you have as a consumer, the courts at your principal place of business or residence in India will have jurisdiction over any dispute, and you and Warmvine agree to try to resolve disputes informally by contacting us first.
14. Changes & contact
We may update these Terms as the app evolves or the law changes. We’ll revise the “Last updated” date and, for material changes, give more prominent notice in the app. Continued use after an update means you accept the revised Terms.
